Terms and conditions
Last updated 28 October 2026
These terms are an agreement between you and Phantom Dialogue AI Pty Ltd (ABN 94 670 034 607) ("we", "us"). They govern your use of:
- the website at ai-gagement.com and its waitlist (the "website"); and
- AI-gagement, our service for managing social media accounts, at app.tryaigagement.com (the "service").
By creating an account, or by using the website or the service, you agree to these terms and to our Privacy Policy. If you use the service for a business or another organisation, you agree on its behalf as well as your own, and you confirm you are authorised to. If you do not agree, do not use the website or the service.
1. The service
AI-gagement helps you manage social media accounts in one place. You can:
- write, schedule and publish posts to the accounts you connect;
- read the comments, mentions and direct messages those accounts receive, and reply to them;
- send posts and replies through an approval process before they go out;
- see how your posts perform; and
- use the Co-pilot, our AI assistant, which describes media, classifies sentiment, drafts replies in your account's voice and writes reports (section 6).
The service currently works with X, Facebook and Instagram. What it can do on each depends on what that platform allows, and may change when the platform changes.
The service is new. It is offered as an early version, and we are still changing it. Features may be added, changed or removed. We will tell you before a change that takes away something you rely on, where we reasonably can.
2. Your account
- You must be 18 or over, and able to enter a binding contract.
- Give us accurate information, including your real first and last name and an email address you control. You confirm your address before you can sign in.
- Keep your password secret. We recommend you turn on two-step sign-in.
- You are responsible for what happens under your account. Tell us straight away at [email protected] if you think someone else has used it.
- One account per person. Do not share your sign-in details. Invite colleagues instead (section 3).
3. Organizations, members and roles
Work in the service happens inside Organizations. Each account comes with a personal Organization for you alone. A shared Organization is set up by us for a team. Its members join only by accepting an invitation sent to their own email address.
Each member of an Organization has a role, which decides what they can do there:
| Role | Can |
|---|---|
| Analyst | View the Organization's content and performance |
| Author | Also write, schedule and publish posts; reply to messages; and act on the Co-pilot's draft replies |
| Manager | Also approve or reject other people's posts, and set the account's voice, the automation rules and the reports |
| Owner | Also connect and disconnect social accounts, invite and remove members, change their roles, and view the activity log |
The owners of an Organization are responsible for it: for who they invite, the roles they give, the accounts they connect, and the rules they switch on. An Organization always has at least one owner.
The content of a shared Organization belongs to the Organization, not to the member who created it. If you leave, or are removed, it stays with the Organization.
4. Connecting social media accounts
When you connect an account you authorise us to act for it on the platform, as you and the members of your Organization instruct, within the permissions you grant. Our actions include publishing, replying, liking, hiding comments, and sending and reading messages.
You confirm that:
- you own the account, or are authorised by its owner to connect it and to let your Organization's members act for it; and
- you will keep to the platform's own terms, rules and policies when you use the service with it, including its rules on automation, messaging and spam.
The platforms are not part of the service, and we do not control them. A platform may limit, change or withdraw what we can do with an account, refuse a post, or suspend an account. We are not responsible for that, or for the platform's own actions, availability or content. Your use of each platform is governed by your agreement with that platform.
You can disconnect an account at any time (Privacy Policy, section 10).
5. Your content
You keep ownership of everything you and your Organization put into the service: your posts, media, replies, notes, rules and other content ("your content").
You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, adapt, transmit and display your content. This includes sending it to the platforms you connect and to the AI providers named in the Privacy Policy. The licence is only for providing, securing and improving the service for you, and it ends when your content is deleted, apart from copies the law, or our Privacy Policy, lets us keep.
You are responsible for your content and for what you publish or send through the service. You confirm you have the rights to it. You also confirm that it does not break the law, infringe anyone's rights, or break a platform's rules.
Other people's information. The service holds the comments and messages people send to your accounts. These are their words, and often their personal information. You must use them only to manage and respond to those conversations, and only in line with privacy law, the platform's rules, and our Privacy Policy. Do not use the service to build profiles of the people who interact with you, or to send them messages they have not invited. Where privacy law treats you as the party responsible for this information, our Data Processing Addendum applies.
6. The Co-pilot and AI-generated content
The Co-pilot uses AI models to describe media, classify the sentiment of messages, draft replies in your account's voice, and write reports. Anything it produces is labelled as the Co-pilot's.
- AI can be wrong. A draft may be inaccurate, inappropriate, out of date or not what you meant. A sentiment label or a confidence score is an estimate, not a fact about the person who wrote the message. Review the Co-pilot's work before you rely on it.
- You decide what is sent. A Co-pilot reply goes out only when a member of your Organization approves it, or under an automation rule your Organization has set up and switched on. Rules are off until you turn them on.
- You are responsible for what is sent from your accounts, whether a person wrote it, the Co-pilot drafted it and someone approved it, or a rule you switched on released it. Set rules with care and check what they send.
- Do not present the Co-pilot's output as something it is not, where a platform or the law requires you to disclose that content was generated by AI.
We do not use your content, or the messages your accounts receive, to train AI models.
7. Acceptable use
You must not use the website or the service to:
- break any law, or a platform's terms, rules or policies;
- send spam, or bulk or unsolicited messages, or take part in coordinated inauthentic behaviour, artificial engagement or manipulation of a platform;
- harass, threaten, defame, impersonate or deceive anyone, or publish hateful, sexually exploitative or violent content;
- infringe anyone's intellectual property, privacy or other rights;
- mislead people about who you are, who is speaking, or whether content was generated by AI, where that matters;
- interfere with the service or its security, test it for vulnerabilities without our written permission, or get around a limit or a security measure;
- access another Organization's data, or anything you are not authorised to see;
- copy, scrape, reverse engineer or resell the service, or use it to build a competing product; or
- use automated means to sign up, or to use the service other than through the features we provide.
We may remove content, pause automation, or suspend access if we reasonably believe these terms are being broken, or to protect the service, other users, the platforms or the public. Where we can, we will tell you first and give you a chance to put it right.
8. The website and the waitlist
The website tells you about AI-gagement and lets you join a waitlist. It is information, not an offer. Joining the waitlist means we will email you once when AI-gagement launches. It does not reserve a place, guarantee access or fix a price, and it creates no obligation on you or on us. We may close the waitlist at any time. Only join with an email address that is yours.
9. Fees
The service is free to use while it is an early version. Before we charge for it, we will tell you the prices and terms, and you will choose whether to accept them. We will not charge you for anything you have not agreed to.
10. Availability and support
We work to keep the service secure, available and accurate. Because it is an early version, and depends on the platforms and on our providers, we do not promise that it will be uninterrupted or free of errors, or that a scheduled post will publish at exactly its scheduled time. We do not guarantee any level of service. Keep your own copies of anything important.
For help, write to [email protected].
11. Our intellectual property
The service, the website, their software and design, and the AI-gagement name and logo belong to us or to the people who licensed them to us. These terms give you the right to use the service as they describe, and nothing more. If you send us feedback or suggestions, we may use them freely and without any obligation to you.
12. Ending your use
You can stop using the service at any time and ask us to delete your account (Privacy Policy, section 10). If you are the last owner of a shared Organization, appoint another owner first, or tell us what should happen to the Organization.
We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering the service. Unless there is a serious breach, a legal reason or a risk of harm, we will give you at least 30 days' notice, so you can retrieve your content.
The sections on content you have published, AI-generated content, intellectual property, liability and governing law continue after these terms end.
13. Our responsibility to you
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law that cannot be excluded.
Subject to that, and to the extent the law allows:
- the website and the service are provided as they are and as available;
- we are not liable for any indirect or consequential loss, or for any loss of data, profit, revenue, reputation, followers or goodwill;
- we are not liable for what a platform does or does not do, for content published or sent from your accounts, or for AI-generated content after a member of your Organization approved it or a rule you switched on released it; and
- our total liability to you for anything arising from these terms, the website or the service is limited to the greater of the amount you paid us in the 12 months before the claim and A$100.
Where the Australian Consumer Law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
14. Your responsibility to us
To the extent the law allows, you agree to cover our reasonable losses and costs from a claim by someone else, so far as it arises from your content, from what you published or sent through the service, or from your breach of these terms or of a platform's terms. This does not apply to the extent the loss was caused by us.
15. Changes to these terms
We may change these terms. If a change is significant, we will tell you by email or in the service at least 30 days before it takes effect, unless it is needed sooner for legal or security reasons. If you keep using the service after a change takes effect, you accept the new terms. If you do not, stop using the service and ask us to delete your account.
16. General
- These terms, the Privacy Policy and any Data Processing Addendum are the whole agreement between us about the website and the service.
- If part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these terms without our consent. We may transfer ours to a buyer of our business, who will be bound by them.
- These terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of its courts and the courts that may hear appeals from them.
